As per reports, sellers of e-commerce platform allege that the probe conducted by India's antitrust watchdog is arbitrary, opaque, and unfair. Flipkart sellers are seeking to halt the investigation through this lawsuit and it may bring more clarity to the proceedings.
As per a report of Reuters, online sellers on Walmart's Flipkart have taken legal action against the CCI. Sellers on Flipkart are trying to stop the investigation being conducted by the CCI by taking legal action in the Karnataka High Court, according to a report of Times of India. It means that they are seeking the court's help to put a pause on the investigation, which may be affecting their business operations. Three sellers on Flipkart have reportedly submitted requests to the court asking it to "set aside" the investigation report and pause the ongoing process by CCI. The sellers are challenging the findings of an investigation carried out by the antitrust authority, which found that they, along with Flipkart and its competitor Amazon, had broken competition laws in India.
A lawsuit has been brought forward by three sellers from Flipkart, which include CIGFIL Retail, Wishery Online, and Xonique Ventures. In their legal filings, they reportedly claim that during the investigation, they were asked to provide information to assist the officials. However, they were later labelled as accused parties in the case, which they believe goes against proper legal procedures. The sellers argue that it is unfair to be treated as suspects. According to reports, a former seller on Amazon filed a lawsuit against the CCI last week and successfully received a temporary court order to stop the investigation from moving forward. In its court documents, the seller reportedly argued that the CCI did not provide any notice before labelling them as an accused party in the case.
