New Delhi, April 18: The Law Commission of India headed by Justice BS Chauhan has recommend that the Board of Control for Cricket in India (BCCI) should be brought under Right To Information Act (RTI). The Law Commission has also recommended that it should be considered as a national sports federation. It has asked the government to classify BCCI as’ state’ under article 12 of the Constitution so that it can be made answerable to government authorities, reported CNN News18.
The commission in its meeting on Tuesday with Union Minister of Law and Justice, Ravi Shankar Prasad informed him that the fundamental rights of the stakeholders were affected by the actions of the BCCI and that the “board has taken a flight under the radar of public scrutiny.” The commission also alleged the BCCI for having a monopolistic approach in regulating the game and it evaded public scrutiny.
If the government accepts the commission's recommendations and classifies BCCI as a public body and brings it under the RTI Act then its working will become transparent. Anyone can file Public Interest Litigations (PILs) in the Supreme Court or High Courts and selection of players representing India, states and zones can be questioned.
Asserting that the cricket board works as a limb of the State, the law panel said, BCCI has received “substantial financing” from appropriate governments in the form of tax exemptions and land grants, reported The Indian Express. The commission was asked by the Supreme Court in July 2016 to recommend whether The BCCI can be brought under the Right to Information Act.
