Woman’s Live-In Partner Cannot Be Prosecuted for Cruelty Offence Under Section 498A of IPC, Says Kerala High Court
The Kerala High Court has ruled that the Section 498A of the IPC applies to legally wedded spouses, not live-in partners.
The Kerala High Court has recently held that a woman's live-in partner cannot be prosecuted under Section 498A of the Indian Penal Code for cruelty. According to Live Law, Justice A Badharudeen also said the Section 498A applies only to legally wedded spouses, adding husband means married man. The ruling comes from a case where the petitioner had asked the High Court to stop the criminal proceedings filed against him by his former live-in partner. She alleges that he had mentally and physically harassed her from March 2023 to August 2023 during their relationship.
