Surrogacy and Maternity Leave Rules: Government of India Amends Central Civil Services (Leave) (Amendment) Rules, Surrogate and Commissioning Mothers To Get 180 Days Maternity Leave
As per the news rules, in the case of surrogacy, the surrogate, as well as the commissioning mother with less than two surviving children, may be granted a maternity leave of 180 days in case either or both of them are government servants, i.e. central government employees.
The Government of India (GOI) recently amended the Central Civil Services (Leave) (Amendment) Rules and called the news rules Central Civil Services (Leave) (Amendment) Rules, 2024. As per the news rules, in the case of surrogacy, the surrogate, as well as the commissioning mother with less than two surviving children, may be granted a maternity leave of 180 days in case either or both of them are government servants, i.e. central government employees. Besides, a central employee who is a commissioning father in case of surrogacy and has less than two living children will be entitled to receive 15 days of paternity leave within six months of the birth of the child. The new rules will came into effect on June 18, the day the rules were published in the Official Gazette.
