Supreme Court recently directed BMW to pay INR 50 lakh to a customer for selling a defective car. The apex court disposed of the 15-year-old cheating case that was pending against BMW India Pvt. Ltd. and certain members of its management. The Supreme Court bench of CJI DY Chandrachud and Justices JB Pardiawala and Manoj Misra directed BMW to pay the money to GVR Infra Projects as compensation in full and final settlement of the dispute. Back in 2009, GVR Infra Projects instituted a criminal case for the offence of cheating against BMW India for supplying a defective car in 2009. Three years later, the Andhra Pradesh High Court quashed the criminal proceedings and directed BMW to provide a new car to the complainant. Although BMW offered to replace the defective car with a new one, the complainant refused and insisted on a refund along with interest. Supreme Court Likely to Get Two New Judges Next Week.
