The Punjab and Haryana High Court recently said that if a minor who is of the "age of discretion" willingly leaves the house of her parents with the accused, he cannot be charged with the offence of kidnapping. Justice Manisha Batra's high court bench observed while granting an accused anticipatory bail. The accused was booked by the Fatehgarh Sahib Police for allegedly kidnapping a 17-year-old girl and forcing her to marry him. In his defence, the accused told the court he was falsely implicated.
