The Allahabad High Court recently granted interim bail to a POCSO accused to enable him to marry the complainant. The court permitted the bail despite the State government's contention that the girl had not attained marriageable age as she was only 17. The high court bench of Justice Rajesh Singh Chauhan passed the order after both the accused and the complainant said they were in a relationship. In his defence, the accused told the court that the case was filed by the victim's family members as she belongs to another religious community. Besides, the court also noted that the complainant had given birth to a child who was now more than a month old. "Immediately after release from jail the applicant shall get married with the prosecutrix within a period of 15 days from the date of release," the court said.
