The Karnataka High Court recently quashed a complaint registered by a man against his wife, who claimed that she wanted to kill him and his mother using black magic. The single-bench judge of Justice M Nagaprasanna observed while allowing the petition filed by the wife. The state's top court quashed the order of reference made for further investigation by the Magistrate court on the private complaint filed by the husband under various sections of the Indian Penal Code (IPC) and Section 3 of Karnataka Prevention and Eradication of Inhuman Evil Practices and Black Magic Act, 2017. "A plain and simple marital discord is dressed with black magic, theft and attempt to murder," the court added. The man filed the complaint on February 21, 2023, before the Magistrate court which later came to be referred for investigation under Section 156(2) of CrPC and FIR came to be registered.
