The Bombay High Court recently directed the release of seven paintings by prominent Indian artists Francis Newton Souza and Akbar Padamsee while reprimanding customs officials for seizing the artwork based on claims of obscenity. The high court bench of Justices MS Sonak and Jitendra Jain emphasised that customs authorities cannot unilaterally impose community standards to deem artwork obscene without adequate justification. The court annulled a July 1 order from the Assistant Commissioner of Customs at the Airport Special Cargo Commissionerate, which had led to the confiscation of the paintings. The justices highlighted that not every nude painting or depiction of sexual intercourse should be categorised as obscene. They also argued that Indian customs regulations do not require renowned artworks, like Michelangelo’s David, to be clothed before entering the country.
