While hearing a petition of a man seeking a divorce, the Allahabad High Court said that no spouse, whether male or female, is expected to continue in a matrimonial relationship under the threat of malicious criminal prosecution. The court observed while hearing a plea in which a man sought divorce from his estranged wife on the grounds of desertion and cruelty. The appellant told the court that his wife had filed a false criminal case against him and accused him of cruelty and dowry harassment. However, the petitioner's brother-in-law testified before the court that no dowry demand was ever made.
