The Calcutta High Court recently quashed a CAT order which dismissed a school teacher for allegedly touching a student during exams. The High Court, while quashing the orders of the Disciplinary Authority, Appellate Authority and Central Administrative Tribunal (CAT), said that there is no sexual flavour in touching a student's shoulder in order to restrain the student from copying in an exam. The middle school teacher was dismissed by CAT after a Class 8 student alleged that the petitioner had outraged her modesty in 2009 after the teacher touched her on her back. The division bench of Justices Suvra Ghosh and Subhendu Samanta noted that the teacher's attempt to restrain the victim from copying in an exam could not be said to have sexual intent.
