The Madhya Pradesh High Court has ordered an enquiry against a trial court judge and clerk after learning that the court, on repeated dates, had negligently posted a cheating case for recording evidence instead of framing charges. The accused-applicant moved a bail plea before the high court and informed Justice GS Ahluwalia about the considerable delay in the trial. After examining the order sheets by the trial court, the High Court found that a few order sheets were typed while the rest were handwritten. The court also noted that the trial court had wrongly posted the matter for recording of evidence on more than one occasion. Thus, the high court viewed that the clerk wrote the handwritten order sheets and were blindly signed by the judge. The state's top court disapproved the trial judge's conduct for negligently signing handwritten order sheets written by a clerk.
