The Madhya Pradesh High Court recently lamented the exploitation of women who remarry without divorce. The high court expressed concern over the "legal loopholes" that prevent a woman who has married for the second time without divorcing her earlier husband from claiming maintenance under Section 125 of the Code of Criminal Procedure (CrPC). The high court bench of Justice Prem Narayan Singh said that despite the "social justice factor" of the provision, its objective gets frustrated in such cases as it fails to prevent the exploitation it otherwise seeks to prevent. "This Court finds it unfortunate that many women, specially those belonging to the poorer strata of society, are routinely exploited in this manner, and that legal loopholes allow the offending parties to slip away unscathed and unquestioned," the court stated.
