The Allahabad High Court, while dealing with allegations regarding assault due to unmet demands of dowry, said that the allegation in the FIR against the husband arose from sexual incompatibility between the parties rather than any actual demand for dowry. "If man would not demand sexual favour from his own wife and vice-versa, where they will go to satisfy their physical sexual urges in a morally civilized society," Justice Anish Kumar Gupta said. In the FIR against the applicant (husband), it was alleged that although there was no demand for dowry before the marriage, the in-laws (parents of the applicant) started demanding dowry under the garb of customs and rituals. It was also alleged that when the wife refused, she was assaulted and abused by her in-laws and her husband. The complaint further alleged that under the influence of alcohol, the applicant tried to kill her. ‘Ample Evidence To Show Accused and Victim Were Residing As Husband and Wife’: Allahabad High Court Allows Trial of Man Booked for Dowry Death of Live-In Partner Who Died by Suicide.
