The Kerala High Court recently said that School Principal compelling students to wear uniform while in school is not an offence of cruelty to child under Section 75 of the Juvenile Justice (Care and Protection of Children) Act. The high court bench of Justice A Badharudeen further said that such insistence is to maintain the discipline of the school and cannot be held as an act which would cause unnecessary mental or physical harm. The state's top court also cautioned that if such acts are considered to be an offence, then it can affect the discipline of the school. The high court observed while hearing the principal's plea to quash the proceedings in the case against him. As per the student, she had reached the school to know her results and purchase books for the next year. However, she said that the principal asked her why she came in a colour dress and even commented that since she is a person with a bulky physique, she should have worn a uniform. The student claimed she was sent back to her house to get her uniform.
