The Kerala High Court recently quashed criminal proceedings which were initiated against a man who was arrested by the police from the roadside for allegedly watching pornography on his mobile phone. While quashing the criminal proceedings against the man, the Kerala High Court observed that privately watching porn videos without exhibiting it to others will not attract an offence of obscenity under section 292 of the Indian Penal Code. The court also added that watching such content is a person's private choice, and the court cannot intrude into his privacy.
