The Meghalaya High Court recently remarked that a 16-year-old adolescent could be deemed capable of consciously deciding to engage in sexual intercourse. This observation led to dismissing a case against a person accused of violating the Protection of Children from Sexual Offences Act (POCSO Act). According to Justice W Diengdoh, it is logical to consider that a minor in that age group, taking into account their physical and mental development, can decide to engage in sexual intercourse.
