Sharing its view on marriage age in the country, the Allahabad High Court recently said that the difference in the legal age for marriage between men and women in India is "nothing but a vestige of patriarchy". It must be noted that the marriageable age for men in India is 21 years and 18 years for women, respectively, at present. The high court bench of Justices Saumitra Dayal Singh and Donadi Ramesh also stated that the legislative intent was to allow an extra three years for men to complete their education and gain financial independence to support their families. However, the court noted that the decision amounted to a denial of the same opportunity to women. The Allahabad High Court observed while dealing with a man's appeal against a family court's refusal to declare his marriage void. The man had sought relief on the ground that the marriage, which took place in 2004, was a child marriage as he was only 12 years old then, and his wife was only 9 years old. After hearing the case, the high court declared the marriage void as it was undisputed that the child marriage had taken place between the couple.
