The court passed the order while hearing a plea challenging the withholding of the man's gratuity due to ongoing criminal investigations under allegations of "moral turpitude". While setting aside the order of the Deputy Chief Labour Commissioner, the single-bench of Justice Shekhar B Saraf said, "The Deputy Chief Labour Commissioner decided upon the issue…depending on the possibility that the petitioner could be found guilty in the pending CBI proceedings."
