According to a division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna, the husband is entitled to a divorce on grounds of mental cruelty if his wife has made such false accusations against him.
The Delhi High Court has stated that a wife falsely accusing the husband and his family members of rape and dowry harassment is extreme cruelty for which there can be no justification. According to a division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna, the husband is entitled to a divorce on grounds of mental cruelty if his wife has made such false accusations against him. The case before the court was an appeal filed by a woman challenging a November 11, 2021, family court ruling that granted the husband's divorce on the basis of mental cruelty.
