The Madras High Court today, August 9, said that the state must exercise restraint while initiating legal action against its own citizens. The court observed while setting aside the preventive detention order passed by the Chennai police against YouTuber Savakku Shankar. The high court bench of Justices SM Subramaniam and V Sivagnanam also said that in the age of internet when information is overflowing from all quarters, it is impossible to initiate criminal proceedings against each and every person who spreads false or fake information. "A State going behind each and every social media post or YouTube videos will not change any one's views; instead it will make the people feel stifled of their right to speech," the court added.
