According to a recent ruling by the Delhi High Court, a husband cannot be held accountable for a wife's dowry death under Section 304B of the Indian Penal Code (IPC) because of an extramarital affair of the husband or his gambling activities. The court made the remarks while giving bail to a man whose wife committed suicide in August 2022, just two years after they were married. In addition, Justice Vikas Mahajan emphasised that in order to use Section 304B of the IPC, harassment of the woman must be connected to a demand for dowry in addition to occurring before the woman passed away. Delhi HC on Husband's Sexual Relationship Outside Marriage: Man's Right To Privacy Doesn't Prevail Over Wife's Right To Seek Evidence for Proving Adultery Allegations.
