The Madhya Pradesh High Court recently said that a husband cannot escape the liability of maintenance by merely citing faults in his wife's pleadings. The court made the observation while dismissing a criminal revision application filed by the petitioner-husband. The High Court stated that a destitute wife claiming maintenance could not be victimised solely based on faults in her pleadings. The woman's husband, a petitioner in the case, had challenged the Family Court's order, which rejected his application under Section 127 CrPC to reduce the maintenance amount.
