In a recent judgement, the Delhi High Court ruled that the definition of mental cruelty is broad enough to include a spouse's financial instability as it granted a divorce to a woman. According to a division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna, a wife's constant financial anxiety due to her husband's lack of stability in his job or business, which ultimately causes him to indulge in other vices, is bound to cause her mental cruelty. The court made the statement while resolving a divorce dispute in which there was a significant gap in the financial circumstances of the separated partners. HC on Drunk Husband: Mental Cruelty to Wife and Kids If Husband Spends Time on Excessive Drinking Instead of Fulfilling Family Responsibilities, Says Chhattisgarh High Court.
