The Calcutta High Court recently said that day-to-day bickering between a husband and wife is not cruelty under section 498A of the Indian Penal Code (IPC). The High Court’s circuit bench also stated that cruelty contemplated under section 498A would be different from the general matrimonial disturbances a couple faces. The court also observed that the general allegations made during the case could not be made to establish a crime under section 498A. The court made the statement while upholding the appellant’s conviction under section 323 IPC for voluntarily causing hurt to his wife. "Cruelty contemplated in Section 498A of the Indian Penal Code is different from day to day bickering between the husband and wife," the single-bench of Justice Sugato Majumder said.
