The Gauhati High Court recently said that if the husband is healthy, able-bodied and in a position to support himself, he is under the legal obligation to support his wife. The high court bench of Justice Malsari Nandi further stated that the husband's plea that he does not have the means to pay because he does not have a suitable job or business is a "bald" excuse that is not acceptable in law. The high court observed while hearing a man's revision plea against a Family Court court order which directed him to pay his wife (respondent No. 2) Rs 2,200 monthly maintenance under section 125 CrPC. Person Declared 'Indian' by FTs Cannot Be Declared Foreigner by Tribunal for Second Time, Says Gauhati High Court.
