The Allahabad High Court recently refused to quash charges of cruelty and dowry death against a man who allegedly claimed to have been only a live-in partner of a woman who had died by suicide. The high court bench of Justice Raj Beer Singh said that even if it were assumed that the victim did not fall within the ambit of a legally wedded wife, there was ample evidence on record to show that the accused and the victim were residing together "as husband and wife" at the relevant point of time. The high court relied upon the observations made by the Supreme Court in Reema Aggarwal vs Anupam and Others in 2004. "The absence of a definition of 'husband' to specifically include such persons who contract marriages ostensibly and cohabitate with such woman, in the purported exercise of his role and status as 'husband' is no ground to exclude them from the purview of Section 304B or 498A, IPC," the court said. ‘It Seems Kalyug Has Arrived’, Says Allahabad High Court on Elderly Couple Fighting Legal Battle Over Alimony.
