Being the delivery driver for the bakery popular among celebrities, David had access to some of the costliest cakes in New York City. A nine-inch cake can be sold for up to $90 or less when resold after stealing.
The bakery, Lady M Confections has branches around the world. It is known for its Instagram-friendly Mille Crêpes cake in which about 20 crepes are stacked together with fluffy cream and topped with a layer of caramelised sugar. The New York Times Magazine once referred to the item in particular "at least the second-best cake in the city". David who worked at the shop for two years was caught on camera more than dozen times sneaking out black bags. According to the lawsuit filed in Queen's civil court, the bags contained cakes that the stole from the bakery. The court papers allege that he had been stealing regularly from November 2018 to February 2019. He took out 357 cakes worth a total of $31,238 in just January. The company said that they did not realise that the cakes were being stolen unless they were sold outside for a lesser rate.
As per the suit, police investigated the case after Lliviganay informed his bosses that he was going on a holiday on Valentine's Day. However, he did not return and was officially fired a month later. He has pleaded guilty to petit larceny and will be sentenced at Queens Criminal Court on September 24. However, now the patisserie owners have filed a civil lawsuit against him. Talking about the charges against David, his sister Daisy Lliviganay said that he has been framed in the case. Lady M which began in 2002 opened its first store in New York in 2004.
