New Delhi, September 4: The Supreme Court on Thursday ordered the Jammu and Kashmir administration to shift ailing CPI(M) leader Mohammed Yousuf Tarigami from Srinagar to AIIMS in New Delhi. Tarigami was put under house arrest since August 5 by the administration post-Centre's announcement of abrogation of provisions of Article 370 that granted Jammu and Kashmir special status. The decision of the apex court comes after CPI(M) general secretary Sitaram Yechury visited the ailing leader last week in Srinagar and following this filed a writ of habeas corpus petition on Monday. Hearing the petition, the Supreme Court directed the authorities to shift ailing Tarigami from Srinagar to AIIMS in New Delhi.

However, the apex court gave the relaxation to the Jammu and Kashmir authorities to decide the time and mode of travel in consultation with doctors in the state. The apex court also allowed Tarigami’s wife or a family member to accompany him. Article 370 Abrogated From Jammu and Kashmir: Home Minister Amit Shah Proposes Scrapping of the Article, What Does the Article State?

Asked by the court on alleged objections, Yechury said that he had no objection to Tarigami being shifted to AIIMS for better medical treatment. He said, "We want to reserve our right to challenge the detention of former MLA Tarigami in Habeas Corpus plea."

Earlier in August 28 decision, an SC bench comprising Chief Justice of India Ranjan Gogoi and Justices S A Bobde and S Abdul Nazeer had said Yechury could visit J&K only to enquire about Tarigami’s health and "for no other purpose". Yechury was also asked to submit a review report for his journey, once he returns to the national capital.
