New Delhi, September 30: The Union Home Ministry is all set to sanction prosecution under the Unlawful Activities (Prevention) Act of Jammu and Kashmir Liberation Front (JKLF) chairman Yasin Malik, Dukhtaran-e-Millat chief Asiya Andrabi and All Party Hurriyat Conference general secretary Masarat Alam. The Union Ministry would sanction prosecution of these leaders for allegedly receiving funds from Pakistan to carry out stone pelting and terrorist activities in 2016 and 2010.

According to the information, the National Investigation Agency -- probing the cases -- might file the chargesheet in the first week of the October, post the attainment of the sanction from the Union Home Ministry. All these three leaders were arrested by the apex probing agency in April this year. It is has been revealed that NIA is mulling mentioning the name of Pakistan-based Jamaat-Ud-Dawa (JuD) chief Hafiz Saeed. The latest development comes 56 days after the Union government imposed restrictions in Jammu and Kashmir, and abrogated Article 370 from the state. Following this, the administration barred all the communication of political leaders in the Valley and had put them under arrest -- house and prison. Meanwhile, Malik, Andrabi and Alam are currently lodged in Tihar Jail of the national capital.

As per the law of UAPA, the Union government's approval is necessary filing the chargesheet under Section 45. Two senior members of the Union Home Ministry would be examining the proposal, before giving their approval. If the NIA fails to get the sanction from the Union Ministry, all these leaders will become liable for bail.

Earlier, NIA had filed chargesheet for leaders like Hurriyat chief’s son-in-law Altaf Fantosh, Bashir Ahmed Bhat -- alias Peer Saifullah, Aftab Hilali Shah -- alias Shahid ul Islam, Kashmiri businessman Zahoor Ahmed Shah Watali, Naeem Khan, Raja Mehrajudin Kalwal, Farooq Ahmed Dar -- alias Bitta Karate, Mohammad Akbar Khandey -- alias Ayaz Akbar and Javed Ahmed Bhat, among others.
