Impeachment Motion Against CJI Dipak Misra: Draft Proposal Circulated to Parties by Congress, Inform Sources  

In the last week, leaders of the Congress, the Trinamool Congress, the Nationalist Congress Party and the Communist Party of India (Marxist) discussed the possibility of moving an impeachment motion against Misra.

New Delhi, March 27: The Congress and some other parties are believed to bring an impeachment motion in Parliament against Chief Justice of India Dipak Misra in the coming days.  A draft proposal for moving an impeachment motion against Misra has been circulated to parties by Congress, sources were quoted by ANI. Misra, the 45th Chief Justice of India(CJI) has been in discussions among party leaders for failing to address the key issues raised by the four seniormost judges concerning the functioning of Supreme Court.

NCP leader DP Tripathi was quoted by ANI saying that a lot of opposition parties have signed a draft proposal for moving an impeachment motion against CJI Dipak Misra. "Many parties like NCP,Left parties and I think TMC and Congress also have signed it", Tripathi added.

The opposition supports Misra's impeachment

As per details by ET, an Opposition leader on Monday informed that that the motion could be moved during the ongoing Parliament session, in the Rajya Sabha if the proposal is signed by 50 MPs. The report further added saying that opposition leaders are planning to reach out to more like-minded parties who feel the same about the CJI.

The Opposition leaders had cited the case regarding the death of Justice BH Loya as an example.  “We don’t see any credible sign of the chief justice still taking initiatives to address extremely vital issues regarding the independent functioning of the top court,” a leader said on condition of anonymity.

Yechury goes public with his impeachment demand

Earlier, CPM leader Sitaram Yechury had gone public with his demand for bringing an impeachment motion against the CJI. “It looks like the crisis is not resolved yet, so we need to intervene and it’s time to play the role of the executive,” Yechury told ANI.

“We are discussing with Opposition parties on the possibility of an impeachment motion against the chief justice in the Budget session”, he added. Now, it seems that all opposition parties wish the same.

Controversies surrounding Misra

Misra has been at the center of an unprecedented controversy in the Supreme Court since the past few months. On January 12, four top judges of the court said their attempts to convince Misra to address a judicial crisis had gone unanswered, and they had to speak out so that “democracy survives”. Justices Jasti Chelameswar, Rajan Gogoi, Madan B Lokur and Kurian Joseph had objected to the way Misra allocated certain cases to various benches.

In the last week, leaders of the Congress, the Trinamool Congress, the Nationalist Congress Party and the Communist Party of India (Marxist) discussed the possibility of moving an impeachment motion against Misra. A report by ET, quoting an unidentified senior Opposition leader saying that the leaders feel that Misra has not adequately addressed the matters the four judges who held a press conference on January 11 had raised.
