Ludhiana, November 3: The District Consumer Disputes Redressal Commission in Chandigarh has directed a fast food restaurant and Zomato Limited to refund INR 154.75 and pay INR 5,000 in compensation to a local resident after a food delivery error caused significant emotional distress to his family.
On April 9, 2023, Suryam ordered vegetarian momos and noodles from Sanju Chinese Fast Food in Chandigarh's Sector 15 via Zomato for his minor daughter and elderly mother, the Indian Express. The family, who strictly adhere to a vegetarian diet due to their Sanatan Dharma beliefs, were shocked to find non-vegetarian momos in their order. Suryam’s mother, who has been on depression medication for 20 years, experienced severe emotional distress upon discovering a bone-like object in the food. Sanju Chinese Fast Food claimed they had correctly prepared and labelled the vegetarian items, suggesting the mix-up might have occurred at Zomato’s end. Zomato did not respond to the Commission’s notice and proceeded against the ex-parte on August 19, 2024. The Commission found both the restaurant and Zomato negligent in their services, leading to the delivery of non-vegetarian food to a vegetarian family. The ruling emphasised the significant mental distress caused to Suryam’s mother and ordered both parties to refund the meal cost and pay Rs 5,000 in compensation for the distress and litigation costs.
