Yamraaj in Court: Kin of Dead Convicts Asks Calcutta High Court to Direct 'God of Death' to Send Them Back Alive to Serve Jail Term

In a bizarre incident, relatives of two convicts, who have died without serving jail term imposed on them, filed a petition in Calcutta High Court seeking direction for Yama or Yamraaj to send back their dead kin back alive.

Kolkata, October 3: In a bizarre incident, relatives of two convicts, who have died without serving jail term imposed on them, filed a petition in Calcutta High Court seeking direction for Yama or Yamraaj to send back their dead kin back alive. The petition seeks permission to initiate contempt proceedings against Yamaraaj if the God of death fails to comply with the court's order, Times of India reported. Lucknow Traffic Police Ropes ‘Yamraj’ for Road Safety Campaign.

In 1987, Samar Chowdhury, his sons Iswar and Pradip and another person were sentenced to five years in prison by a local court. They were found involved in a case of violence that resulted in a death in 1984. They challenged their conviction in Calcutta High Court which passed an interim order and suspended their sentences. Before the hearing could start, Samar and Pradip died. While Pradip died on February 17, 1993, Samar died on September 16, 2010. During the hearing on their petition challenging the lower court's order, the Culcutta High Court was never informed that two appellants had died. Six years after their deaths, on June 16, 2016, the High Court upheld their conviction and sentences. There were other twists as well.

On June 22, 2006, the advocate on record for the appellants was elevated as an HC judge and on March 2012 their senior advocate died. The advocates had appeared for appellants pro bono, the relatives told TOI. After their conviction was upheld, Samar’s son Ashoke Chaudhuri and Pradip’s widow Renu has filed a petition praying for condonation of delay (for informing court of the deaths at a later date) and recall of the order of 2016.

"In the event this application is dismissed, this Hon’ble Court may be pleased to direct the Registrar, Appellate Side of this Hon’ble Court to forthwith communicate the order dated 16.6.2016 up on Yama or Yamraaj, the God of Death," read the petition. "In the event Yama or Yamraaj fails to do so the applicants crave leave to initiate civil contempt proceeding against Yama or Yamraaj," they further stated.
