Wife Given Life Imprisonment For Not Crying At Husband's Death Acquitted by Supreme Court

According to reports, the woman was convicted for murder of her husband just because she was the last person to be seen with her husband before he was murdered.

New Delhi, November 1: A woman in Assam spent five years in prison while undergoing life imprisonment allegedly for not weeping at her husband’s death. According to reports, the woman was convicted for the murder of her husband just because she was the last person to be seen with her husband before he was murdered. According to a report by TOI, the Supreme Court on Thursday came in support of the female and refuted the claims and reasonings of the trial court and Gauhati high court.

The TOI report informs that the Apex court on Wednesday set aside the woman’s conviction and refused to give credence reasoning of the lower courts. The trial court and the Gauhati high court had held that her unnatural conduct by not crying at the time of her husband's unnatural death proved her guilt beyond doubt. The bench comprising of Justices R F Nariman and Navin Sinha, however, claimed that circumstantial evidence did not lead to inescapable conclusion that the woman had killed her husband and directed her release from custody forthwith. The report informs that the trial court and the HC strongly believed that as she was last seen with her husband on the day of his death, makes her the one who killed her. Moreover, the lower courts said the incident established her presence with the deceased and held her "unnatural conduct" of not crying proved that she was the killer of her husband.
