Swiggy Ordered to Pay Rs 1,000 to Customer for Failing to Refund Rs 104, Consumer Court Cites Mental Harassment
A consumer court in Ahmedabad has ordered popular food delivery platform, Swiggy, to compensate a customer for the mental distress caused by a cancelled order. The court ordered Swiggy to pay the man Rs 1,000 after he claimed that he did not receive his order even though he had already paid for it.
Ahmedabad, May 13: A consumer court in Ahmedabad has ordered popular food delivery platform, Swiggy, to compensate a customer for the mental distress caused after the food-delivery platform failed to pay Rs 104 refund to the man. The court ordered Swiggy to pay the man Rs 1,000 after he claimed that he did not receive his order even though he had already paid for it. The case, which dates back to 2022, was brought forward by Prasad Kanade, a resident of Bhadra, Ahmedabad.
According to a report in TOI, Kanade had placed an order for sweets on Swiggy in November 2022, for which he paid Rs 549. However, the order was never delivered, and Kanade only received a partial refund of Rs 445. Swiggy failed to inform Kanade about the cancellation in advance, leading to his dissatisfaction with the service. In response to the complaint filed by Kanade with the Consumer Dispute Redressal Commission, Swiggy argued that they merely acted as an intermediary, connecting customers with restaurants and delivery agents, and therefore should not be held responsible for issues related to orders. The platform also claimed that it was Kanade who had cancelled the order. However, the commission ruled in favor of Kanade, stating that since Swiggy accepted payment for the service, they are a service provider and are responsible for ensuring a smooth transaction. As a result, the commission ordered Swiggy to refund the remaining Rs 104 with a 9% interest and pay Rs 1,000 as compensation to Kanade for the mental strain caused and the litigation costs.
