Supreme Court to Consider Re-Assessing Criminal Justice System in Response to Sexual Offences, Wants Centre and States to Respond by February 7

A bench headed by Chief Justice of India (CJI) SA Bobde asked the Central Government and all states and UTs to file their responses and posted the matter for hearing on February 7, 2020. The Supreme Court informed Centre of its decision through Home Secretary and the states, UTs through the Chief Secretaries, reported ANI.

New Delhi, December 18: The Supreme Court on Wednesday issued notice to the Central government, states and the Union Territories (UT), seeking their response and taking suo motu cognizance regarding assessment of criminal justice system in response to sexual offences. The Supreme Court's notice comes days after CJI Sharad Arvind Bobde said that the criminal justice system of the country must be reformed.

Chief Justice of India (CJI) Sharad Arvind Bobde had said on December 7 that justice can never be delivered in form of revenge. CJI Bobde was apparently referring to celebrations that broke out after all four accused in the rape and murder of a 27-year-old veterinarian were killed in an alleged encounter by Telangana police. The rape-murder and burning of a 27-year-old female doctor in Telangana raised demands from various quarters for justice through swift mechanism and many demanding death penalty for the accused.

Vice President Venkaiah Naidu, in an apparent reaction on Chief Justice of India (CJI) Sharad Arvind Bobde's remark, said that, "I saw a statement by Chief Justice of India, very aptly he said 'you can't give instant justice'. But at the same time you can't have constant delays. It's an area of concern for all of us&everyone should see to it that their duties are well performed."
