No EWS Quota For PG Medical Students in Maharashtra, Says Supreme Court

The Supreme Court of India on Thursday said that 10 per cent Economic Weaker Section (EWS) quota cannot be applied to Post Graduate medical courses in Maharashtra for the academic year 2019-2020 as the admission started much long before the provision came into force.

Mumbai, May 30: The Supreme Court of India on Thursday said that 10 per cent Economic Weaker Section (EWS) quota cannot be applied to Post Graduate medical courses in Maharashtra for the academic year 2019-2020 as the admission started much long before the provision came into force. The bench of Chief Justice of India Ranjan Gogoi and Justice Aniruddha Bose said that 10 per cent EWS cannot be granted unless additional seats are created by the Medical Council of India.

The apex court noted that the admission for Medical PG courses started in November 2018 while amendment granting 10 per cent EWS quota was passed in January this year. The bench added that Maharashtra government can enforce EWS quota for PG medical courses in March. EWS Quota: Cabinet Approves 10% Reservation For General Category in Central Educational Institutions.

"At this stage, the State can act under the enabling provisions and introduce reservation but unless additional seats are created by Medical Council of India (MCI), the existing seats cannot be subjected to the EWS reservation amendment," the bench said.

Rajat Rajendra Agrawal, a student, had challenged two circulars of the Maharashtra government by which ten per cent Economic Weaker Section quota was enforced in Post Graduate medical courses of the state.
