Mumbai: Man Takes Shirt Off in Front of Women Cops, Jailed For 10 Days

Mumbai, March 6: A 38-year-old man was handed a 10 day sentence by a magistrate's court recently forĀ removing his shirt and making an indecentĀ gesture in front of women officers in a fit ofĀ anger at a police station. The court convicted theĀ Dadar man, Ganesh Kharwa, along with BabuĀ Kharwa, a man he was fighting with in public inĀ 2016.
Finding Ganesh guilty of the Indian Penal CodeĀ charge relating to performing of obscene acts,Ā additional chief metropolitan magistrate S RĀ Narwade said, "It is proved that accused didĀ obscene act in public place, which causedĀ annoyance to the police cops, more particularlyĀ lady copsā.
According to a report in Times of India, The court refused to let the two men off on aĀ bond of good behaviour under the Probation OfĀ Offenders Act. The Act allows an accused to beĀ released on a bond of good behaviour instead ofĀ him serving a sentence.Ā "The accused have committed the offence onĀ (sic) public places without fear of anybody andĀ created havoc in the society. However, accusedĀ No 2 (Ganesh Kharwa) has committed obsceneĀ act in police station in presence of lady cops.Ā Therefore, it would not be just and proper to gĀ the accused the benefit of the Probation OfĀ Offenders Act. Both the accused men involved in the fight inĀ public were also found guilty by the magistrate'sĀ court of the offence relating to "disturbing theĀ public peace and committing affray" andĀ sentenced by the court to 10 days' imprisonmentĀ each. The defence lawyer submitted that theĀ prosecution has examined only the policeĀ witnesses in the case. The lawyer furtherĀ submitted that on the basis of the interestedĀ witnesses, the quilt of the accused cannot beĀ proved in the matter.
The magistrate's court, however, said thatĀ though the the act of the two men wasĀ disturbing public peace, no individual had aĀ particular interest and was affected by it.Ā Therefore, no independent witness had comeĀ forward and made a statement against them.Ā "However, it is judicial (sic) noticeable fact thatĀ the public in Mumbai metro city are always inĀ hurry to reach their destination. No one isĀ expected to wait for long period to giveĀ statement in a case, in which he has noĀ substantial interest," the magitstate's court saidĀ in its verdict in the matter..
