Guwahati, December 15: Days after saying that India should have been declared a Hindu country, Justice Sudip Ranjan Sen of Meghalaya High Court on Saturday claimed that he said nothing against the secular structure of the country. In a statement, published on the official website of the Meghalaya High Court, Justice Sen also clarified neither he belongs to any political party nor has political ambitions.
"Secularism is one of the basic structures of our Indian Constitution. It should not further be divided on the basis of religion, caste, creed, community or language... I would also like to clarify here that in my judgment nowhere I have said anything against secularism and my judgment makes references to the history and one cannot change the history," Justice Sen wrote. He stressed his judgement was not outside the ambit of the Constitution. Query on Cow Slaughter by Muslim in Front of Hindus in Indraprastha University's Law Paper, Inquiry Ordered.
"Whatever is the truth, history and real ground reality, on that basis I have written my judgement to save the citizens of India irrespective of caste, creed, religion or language and people should understand the history of India and live in peace and harmony," Justice Sen said. Delivering his judgment in a case pertaining to domicile certificate on Monday, he said India should have been declared a Hindu country after the partition.
"Pakistan declared themselves as an Islamic country and India since was divided on the basis of religion should have also been declared as a Hindu country but it remained as a secular country," Justice Sen, who became a permanent judge of the Meghalaya High Court in January 2014, said. He added nobody should attempt to make India an Islamic country and Prime Minister Narendra Modi will understand this.
"I request our beloved Prime Minister, Home Minister, Law Minister and Hon’ble Members of the Parliament to bring a law to allow the Hindus, Sikhs, Jains, Buddhist, Parsis, Christians, Khasis, Jaintias and Garos who have come from Pakistan, Bangladesh and Afghanistan to live in this country peacefully and with full dignity without making any cut off year and be given citizenship without any question or production of any documents," Justice Sen said in his judgment.
A political row erupted over Justice Sen's remarks with the Communist Party of India (Marxist) saying that it was considering an impeachment motion against him. The CPM Friday urged Chief Justice of India Ranjan Gogoi to remove Sen from his judicial duties, alleging that his remarks were against the basic structure of Indian Constitution.
