This decision, enacted under the provisions of a food safety Act, follows a recent viral video showing a child in Karnataka experiencing distress after consuming a "smoke biscuit" infused with liquid nitrogen. Investigations revealed the potential dangers of liquid nitrogen consumption, prompting swift regulatory measures.

According to a report by ETV Bharat, under the Food Safety and Standards (Food Products Standards and Food Additives) Regulation, 2011, liquid nitrogen is permitted only for specific use cases such as frothing agent, packaging gas, and catalyzer. However, reports indicated its misuse in ready-to-eat foods, leading to health risks. As per a report by The Hindu, offenders, including those without regulatory compliance or safety certification, face fines up to Rs 10,000, while holders of Food Safety Licenses could be fined up to Rs 2 lakhs.
