Karnataka High Court Says Man's Plea Seeking Mobile Info of Wife's Alleged Lover to Prove Illicit Relationship Violates Privacy
Karnataka high court has ruled that seeking cellphone info of wife’s ‘lover’ flouts privacy. The court further said that violation of a third party's privacy cannot be allowed on a man's specious plea that he wants to prove his wife's illicit relationship.
Bengaluru, December 14: Karnataka high court has ruled that seeking cellphone info of wife’s ‘lover’ flouts privacy. The court further said that violation of a third party's privacy cannot be allowed on a man's specious plea that he wants to prove his wife's illicit relationship. Justice M Nagaprasanna pointed out that it is for the first time that the petitioner has been brought into the picture merely on an allegation of illicit relationship though he is basically a third party to the proceedings.
The family court was hearing a petition filed by a 37-year-old woman in 2018, seeking the annulment of her marriage on the ground of cruelty, the TOI reported. The court summoned the tower details on an application from her 39-year-old husband, who alleged that she had an illicit relationship with the petitioner. The judge also quashed the family court order to a mobile service provider to submit the petitioner's mobile tower details in a matrimonial case between the couple saying a citizen has a right to safeguard the privacy of his own, his family, marriage and other incidental relationships. Justice Nagaprasanna said that informational privacy also forms an integral part of right to privacy. Therefore, the family court's order directing that the mobile phone tower details pertaining to the petitioner be placed before it in a proceeding in which he is not even a party undoubtedly violates informational privacy,"
The petitioner had challenged a February 23, 2019 order by 5th additional principal judge, family court, Bengaluru, summoning mobile tower record details of the cellphone number he was using. The petitioner's contention was that summoning his mobile tower records was tantamount to getting his call records. The judge also said that the husband has not filed the case before the family court.
