Kanhaiya Kumar Need Not Pay Fine, Delhi High Court Sets Aside JNU Probe Team Order Calling it 'Irrational & Illegal'
The JNU probe team had imposed a fine of Rs 10,000 on Kanhaiya Kumar after it found that the organisers of the event, which included India, had ignored the permission process.
New Delhi, July 20: The Delhi High Court has set aside Jawahar Lal Nehru's (JNU) move to penalise Kanhaiya Kumar for breach of discipline. The court in its statement termed the JNU committee's decision to impose a financial penalty on Kanhaiya as "illegal, irrational and irregular." The Delhi High Court has also asked JNU to decide Kanhaiya's matter after a proper hearing.
Earlier, the Delhi High Court on Wednesday had directed the Jawaharlal Nehru University (JNU) not to take any "coercive steps" against the former JNUSU President Kanhaiya Kumar till Friday, as the court was confident of announcing its decision. The High Court today set aside JNU's move to penalise Kanhaiya and also termed the order against him as illegal and irregular. Check the tweet by ANI below:
The case is related to the 2016 incident when anti-India slogans were allegedly raised inside the JNU campus during an event. Kanhaiya Kumar, the former Jawaharlal Nehru University Students Union leader, was arrested by Delhi police. The police had also filed a case of sedition against Kanhaiya and fellow student Umar Khalid, as it held Kanhaiya responsible for the event naming him as one of the organisers of the event where the slogans were raised. Kumar was released on interim bail on 2 March 2016 for lack of conclusive evidence.
But simultaneously, a disciplinary committee which was constituted by JNU's then Vice-Chancellor also investigated the event and stated that the organizers had ignored the 'permission process' for the event. The university took disciplinary action against the students involved, and a fine of Rs 10,000 was imposed on Kanhaiya Kumar. The High Court has now set aside the JNU committee's fine imposed on Kanhaiya Kumar.
