New Delhi, Sep 1: The Chief Justice of India (CJI), Dipak Misra has written to the government recommending the name of Justice Ranjan Gogoi who will succeed him upon his retirement on October 2. CJI Dipak Misra sent Justice Ranjan Gogoi's name after the Law Commission requested him to name his successor. Justice Gogoi is expected to take over as Chief Justice of India on October 3.

Justice Ranjan Gogoi, who will retire on November 17, 2019, was among the four judges who held an unprecedented press conference on January 12 against CJI Misra. As per convention, the outgoing CJI sends the recommendation about his successor 30 days before he is to demit office so that the Chief Justice designate is named well in time.

There was speculation that CJI Misra may recommend someone else for the post of Chief Justice. Constitutional law expert and senior advocate Rajeev Dhavan referred to the unblemished judicial records of Justice Gogoi and said if he is not recommended for the post of the CJI, then it would amount to supersession as had happened in the 1970s.

During 1970s, the then central government had superseded the senior most judges and appointed Justice A N Ray as the CJI in 1973, leading to resignations by Justices J M Shelat, K S Hegde and A N Grover. Later, Justice H R Khanna was superseded and Justice M H Beg became the CJI, which had led the former to quit.

Who is Justice Ranjan Gogoi?

Born on 18th November, 1954, Justice Gogoi joined the Bar in 1978. He was appointed as Permanent Judge of Gauhati High Court on February 28 in 2001. In 2010, he was transferred to Punjab & Haryana High Court. On February 12, 2011, he was appointed as Chief Justice of Punjab & Haryana High Court. He was elevated as Judge of the Supreme Court on April 23 in 2012.
