MHA gives Governor Satya Pal Malik full powers to seize Jamaat-e-Islami’s assets under UAPA in Jammu and Kashmir following a ban on the outfit
New Delhi, March 2: The Union Ministry of Home Affairs gave full powers to the Governor of Jammu and Kashmir – Satya Pal Malik – on Friday to order the seizure of funds, properties and assets of the banned outfit Jamaat-e-Islami (JeI) under Section 42 of the UAPA, said sources. The Union government led by Prime Minister Narendra Modi had banned the outfit on Thursday.
According to Section 42 of the UAPA act, the government ‘may delegate all or any of the powers which may be exercised by it under Section 7, or Section 8, or both’. Under Section 7 of the act, the government has the authority to prohibit the use of funds of an unlawful association, while Section 8 deals with the notification of notifying places used for the purpose of an unlawful association. A state government official said, as reported by Indian Express, Jel office might be sealed under Section 8 of the act. Jamaat-e-Islami of Jammu & Kashmir Banned Under UAPA.
Earlier on Thursday, PM Modi approved the MHA proposal to ban JeI under the provision of Section 3 (1) of UAPA, 1967, after the Cabinet Committee on Security (CCS) meeting in New Delhi. In the notification, the Centre opined that the Jamaat is “in close touch with militant outfits” and supporting extremism and militancy in Jammu and Kashmir and elsewhere.
The MHA in its proposal had cited JeI’s close association with All Party Hurriyat Conference (APHC). It said, “A conglomerate of organisations with separatist and terrorist leanings, APHC has been ideologically supporting Pakistan-sponsored violent terrorism. JeI (J&K) was instrumental behind APHC with the support of Pakistan.”
With MHA imposing a five-year ban on the outfit, it also held JeI responsible for the formation of Hizbul Mujahideen (HM). The senior official added, as the daily quotes, “This organisation has nothing to do with Jamaat-e-Islami Hind. In 1953, JeI J&K enacted its constitution. It is the main organisation responsible for the propagation of separatist and radical ideology in the Kashmir valley. The group is also responsible for the formation of Hizbul Mujahideen (HM).”
