The Madhya Pradesh High Court recently considered a case in which the appellant sought her marriage to be declared either void or voidable under sections 11 or 12 of the Hindu Marriage Act, 1955. The woman wanted her marriage to be declared void on the grounds that she was a minor at the time of the marriage and that her husband had concealed his blindness in one eye. The high court bench of Justices Vivek Rusia and Binod Kumar Dwivedi further said that even if the remedy is not present under Section 11 or 12, then under Section 13 of HMA, divorce can be claimed on grounds of the minor woman being married to a major and it will fall under the term cruelty.
