Article 370 Revoked in Jammu and Kashmir: Modi Govt's Move to Scrap Special Status Challenged in Supreme Court
With Narendra Modi-led Union government scrapping the special status of Jammu and Kashmir granted under Article 370, it has been challenged in the Supreme Court on Tuesday. Advocate ML Sharma in the apex court filed the petition calling the amendments made to Article 367 are ‘illegal’ and ‘unconstitutional’.
New Delhi, August 6: With Prime Minister Narendra Modi-led Union government scrapping the special status of Jammu and Kashmir granted under Article 370 on Monday, it has been challenged in the Supreme Court on Tuesday. Information is pouring out that a petition has been filed by Advocate ML Sharma in the apex court, calling the amendments made to Article 367 are ‘illegal’ and ‘unconstitutional’.
The petition filed in the Supreme Court has urged that 'issue writ of mandamus to respondent no.1 for quashing of the impugned notification GSR551 (E) order 2019 dated 5th August of 2019, for amending Art 367 of the constitution of India, being illegal, unconstitutional and void ab-initio & ultra vires to the constitution of India to provide justice'. Earlier, Union Home Minister Amit Shah on Monday proposed to revoke the special status under Article 370 and bifurcate the state into two Union Territories — Jammu & Kashmir and Ladakh. Along with the Amendments in Article 370, Centre amended 367 and added clause 4 under which 'Constituent Assembly' was replaced with the 'Legislative Assembly'.
In order to tackle the legal challenge associated with the Amendments, the Modi government replaced the Constituent Assembly with the Legislative Assembly. As the state is under Governor’s rule, President Ram Nath Kovind needed to have his concurrence to pass the order that he did, revoking all the special powers accorded to the northern state.
