Aadhaar Linking With Bank Account: Bombay HC Pulls Up Shipping Corporation For Withholding Employee's Salary For 2 Years

The Supreme Court had earlier ruled that Aadhaar card is not mandatory for opening a bank account and that telecom companies are not allowed to ask for Aadhaar cards as proof at the time of issuing sim cards.

Mumbai, November 20: The Bombay High Court, hearing a plea on salary of an Union Ministry of shipping employee being withheld for not linking his bank account to Aadhaar, came down heavily upon the ministry of shipping for holding back the salary of the employee for over two years. The bench was of the opinion that refusing to credit the employee's salary just because the employee didn't want to link his bank account to Aadhaar is wrong. The court ordered that arrears of the employee be released and further posted the hearing of his case on January 9, 2019. Aadhaar Declared Constitutionally Valid by Supreme Court, But It's Not Mandatory to Link it With Bank Accounts, Mobile Numbers.

A report in The Times of India said that Ramesh Purale, an employee of the Union Shipping Corporation, refused to link his bank account citing privacy issues. Purale said that forcing him to link his account to Aadhaar card is a violation of his fundamental rights. When Purale's salary was stopped from July 2016, he decided to approach the Bombay High Court. The High Court said in its observation that Purale cannot be forced to link his account to Aadhaar. The Supreme Court had earlier ruled that Aadhaar card is  not mandatory for opening a bank account and that telecom companies are not allowed to ask for Aadhaar numbers as proof at the time of issuing sim cards.
