Think Before Calling Your Wife ‘Kali Kaluti’, Punjab and Haryana HC Allows Woman to Divorce Her Husband

Chandigarh, May 31: Be careful the next time you call your wife 'kali kaluti' as it may land you in trouble! Yes, you read it right! The Punjab and Haryana High Court has allowed a woman from Mahendergarh in Haryana to divorce her husband on the ground of cruelty. According to a report by TOI, the woman was forced to stay away from her husband and family because of her skin colour.
The report states that the court accepted her plea as she was traumatised because her husband would often taunt about the colour of her skin in front of other people. The Haryana High Court observed that the victim (the wife) was able to establish that she was maltreated and treated shabbily as a result of which she was compelled to stay away from the matrimonial home.
A division bench comprising of Justice M M S Bedi and Justice Gurvinder Singh Gill passed the orders and allowed the divorce. The bench setting aside the verdict of the family court in Mahendergarh, which had dismissed the wife's plea.
According to a report by TOI, the order states that the evidence produced on record is held to be good enough to arrive at a conclusion that the appellant was treated with mental and physical cruelty. The report further informs that the woman’s counsel, J P Sharma, argued that the husband had been ill-treating her in public since the start of their marriage and called her ‘kali kaluti’.
Reports further inform that her husband kept pestering and torturing her for not making proper food for him. In November 2012, she had no option but to return to her parents' house due to his irritating and inhuman behaviour over the years.
