You may have come cross various pleas made by applicants in the court. A similarly strange but intriguing case has come to light in Bengaluru. According to a PTI report, a human resource professional from Bengaluru moved the Supreme Court on Thursday, March 15, asking his father's details or biometric data to be handed back to him that had been collected for the purpose of issuing an Aadhaar card to his father. The name of the son is Santosh Min B and the reason he has demanded his father's information back is because he believes that the UIDAI has no use of the information related to his father because he died a few years ago. He also expressed his anxiety over his father's details "getting misused."

Santosh, who according to the report, works with an ayurvedic clinic also narrated a very dramatic picture of his father's life which nonetheless is true according to him. Santosh said that his father died because he felt insulted when he was filling the life certificate form at a provident fund office in his city, Bengaluru. He claimed that his father's biometrics authentication had failed while filling and verification of the provident fund form due to old age and eye surgery and added that his father felt humiliated at this incident.

The case was heard by a five-judge constitution bench which was headed by Chief Justice Dipak Misra. The bench gave two-minutes time to Santosh Min B to argue his case. In his argument, Santosh said that the Aadhaar scheme is like an “undeclared emergency”. According to the PTI report, while arguing he said that “This court may direct the Unique Identification Authority of India (UIDAI) to hand over my dad’s biometric in a printed form, so that I can keep it for posterity,” he told the bench. The bench comprised of justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan.

Santosh later claimed that he had found a letter written by his father N Bhanu Vikaraman and said that his father was troubled by having to go through formalities at old age. The bench, recorded his submissions and set the matter for further hearing on March 20. The apex court had earlier extended the March 31 deadline and said that Aadhaar linking could not be made mandatory to avail various services and welfare schemes till Supreme Court decides so.

This case is one of its kind and this is the first time that someone has moved the Supreme Court to get back the details of his relative or family member from UIDAI collected for Aadhaar. It would be interesting to see the outcome or further progress on this case.
