Government School Teacher Arrested For Allegedly Raping 17-Year-Old in Jammu and Kashmir's Baramulla District

Srinagar, May 1: In yet another shocking incident from the valley, a 17-year-old was allegedly raped by her teacher in Kreeri, Baramulla. The case was reported to police on April 14. The entire incident came to the forefront after the victim was accompanied by the teacher to a clinic at Pattan to get her pregnancy aborted.

Speaking to The Indian Express, Senior Superintendent of Police Baramulla, Imtiyaz Hussain Mir said, “Suspecting a medico-legal case, the doctor informed the police, and subsequently we registered an FIR on the same day.” The teacher, Shiraz Zargar, teaches in same the government school in which the victim studies. Zargar is also her neighbour. According to The Indian Express report, the SSP said, “He told police that he had girl’s consent, but since the girl is minor, the consent is invalid. The teacher, also formerly her custodian in school, is between 28 to 30 years old.”

An FIR was registered on April 15, under sections 376 (rape) and 315 (Act done with intent to prevent a child being born alive or to cause it to die after birth) of Ranbir Penal Code. The accused was arrested the following day and is in the police custody.

Earlier this month, another case of rape of a 14-year-old girl was reported in Jammu and Kashmir’s Ramban district, when the girl was found to be eight months pregnant. She gave birth to a girl. The minor’s mother had filed a complaint about her girl being raped. The accused was arrested the same day in the Batote police station.

In the state of Jammu and Kashmir, Ranbir Penal Code is applicable as Indian Penal Code is invalid because of the special status is given to the state under article 370 of the Indian Constitution. The code was introduced during the reign of Dogra dynasty with Ranbir Singh as its ruler. The code works on the lines of the Indian Penal Code.
